Subject matter of the contract
The subject matter of this contract is the organisation, management and actual execution of an individual combined trip, pursuant to Royal Legislative Decree 1/2007 of 16 November and Law 7/1998 of 13 April, comprising exclusively the services included and described in this document.
The trip is organised and executed by WAYURE TRAVEL, SOCIEDAD LIMITADA (hereinafter "WAYURE") as Organiser, with registered office at Rúa Fernando III o Santo 32, 15701 Santiago de Compostela (A Coruña), Spain, VAT ES B67844159, Licence XG-803, email hello@wayure.com.
The total price of the contracted trip includes only the services expressly indicated as such in this document. Any service, benefit, activity or cost not expressly indicated as included shall be deemed excluded from the trip price and shall be borne exclusively by the Traveller.
This contract constitutes the only valid contractual document between the parties with regard to the organisation and execution of the trip.
02
Booking process
This contract contains in a complete, clear and exhaustive manner all the conditions, services and characteristics of the combined trip purchased by the Traveller.
No service, benefit or characteristic indicated in descriptive programmes, PDF documents, web pages, email communications, messages or promotional materials shall be deemed included in the trip price unless expressly indicated in this contract or its annexes.
The contract shall be deemed concluded and legally binding on both parties upon signature by electronic signature by the Traveller and upon receipt by WAYURE of the required payment.
Commencement of operational management
WAYURE will commence definitive operational management of the trip, including confirmation of accommodation and planned services, exclusively upon payment of:
- a deposit equal to 30% of the total price of land services, plus full payment of any included transport services, where booking takes place more than 30 days in advance;
- the full trip amount, where booking takes place less than 30 days before the departure date.
In the absence of the required payments, WAYURE shall not be obliged to proceed with the confirmation or organisation of the trip. Any subsequent unavailability of services cannot be attributed to WAYURE.
03
Trip cost
The total cost of the trip, inclusive of all applicable taxes, is indicated on page 1 of the individual contract and represents the overall consideration for the contracted services.
The trip price does not include, by way of example and without limitation:
- Tourist taxes, local taxes or levies applied by accommodation facilities or local authorities, which must be paid directly by the Traveller;
- Services, activities or costs not expressly indicated as included in the contract;
- Any additional costs arising from subsequent requests or changes to contracted services.
3.1 Conditions for minors
The possible application of reduced rates for children or minors will be assessed on a case-by-case basis, depending on age, type of trip and conditions applied by suppliers. In the absence of specific indications, the full price shall apply.
04
Payment deadlines and methods
4.1 Deadlines
At the time of booking, the Traveller is required to pay a deposit equal to 30% of the total price of land services, plus full payment of any included transport services (air tickets, rail tickets, etc.) prior to their issuance.
The balance of 70% must be paid no later than 30 days before the departure date. Failure to pay within the established deadlines results in automatic termination of the contract due to the Traveller's fault, with application of the penalties set out in article 9.
4.2 Changes in transport services
Should the price of transport change prior to final purchase, WAYURE will promptly inform the Traveller. The Traveller may accept the new amount or cancel the trip with application of cancellation penalties. Changes communicated to the Traveller will be limited to the actual increase applied by the carrier, without any additional markup by WAYURE.
4.3 Payment methods
Payments may be made by:
- Bank transfer to the indicated account details;
- Credit or debit card via Abanca virtual POS;
- Online payment platforms (e.g. Stripe) made available by WAYURE.
WAYURE will issue a regular receipt for each payment made.
4.4 File opening fee
Prior to signing the contract, WAYURE requires payment of a file opening fee (deducted from the total cost upon signing):
Trips up to 15 days, max 5 participants
€ 129.00
One hundred and twenty-nine/00 euros
Trips of 16+ days or more than 5 participants
€ 249.00
Two hundred and forty-nine/00 euros
The fee allows WAYURE to commence availability searches, block travel services and cover initial organisational costs.
The file opening fee is non-refundable in the event of cancellation by the Traveller, failure to sign the contract or inability to proceed for reasons attributable to the Traveller.
It will be refunded only if WAYURE is unable to find availability on the requested dates (refund within 14 working days of the cancellation notice).
05
Price revision
The trip price may be revised, either upward or downward, exclusively in the following cases:
- a) Changes in transport prices, arising from the cost of fuel or other energy sources;
- b) Changes in the level of taxes or duties on travel services (tourist taxes, port and airport charges, local authority surcharges);
- c) Changes in the exchange rate, where the price of one or more services is expressed in a currency other than the euro.
The revision may be carried out with a minimum notice of 20 days before departure, communicated in a clear and reasoned manner to the Traveller.
Once the trip has been confirmed and the contract signed, any subsequent changes in the exchange rate shall not result in changes to the agreed price, which remains fixed and guaranteed by WAYURE for the entire duration of the contract.
06
Passports, visas and health requirements
WAYURE provides, where possible, general information on the entry requirements for the destination countries. Such information is purely informational and does not replace official verification.
It is the exclusive responsibility of the Traveller to obtain, prior to departure, all necessary documentation, including by way of example:
- A valid passport meeting the requirements of the destination and transit countries;
- Any entry visas, travel authorisations or special permits;
- Health certificates, mandatory or recommended vaccinations, medical tests.
For minor travellers (under 18 years of age), it is mandatory to carry written authorisation signed by both parents or legal guardians, where required.
Any damages, costs, penalties or repatriations arising from the lack or non-compliance of documentation are the exclusive responsibility of the Traveller.

6.1 Traveller's responsibility
The Traveller acknowledges being solely responsible for verifying the updated requirements and that such requirements may change even at short notice. WAYURE is not responsible for changes to entry, health or safety requirements that occur after the contract is signed.
07
Contract modifications
WAYURE undertakes not to unilaterally modify the services included in this contract, unless the modifications are of an insignificant nature.
WAYURE reserves the right to modify accommodation facilities within the agreed categories, quality level and overall characteristics of the experience, where this becomes necessary for organisational or availability reasons. Such variations, provided they comply with the agreed standards, do not constitute a material modification of the contract.
Where material modifications become necessary, WAYURE will promptly notify the Traveller in writing. The Traveller acknowledges that such modifications do not give rise to a right of withdrawal without penalties: any cancellation will result in the application of penalties set out in articles 8 and 9.
In the absence of a notice of cancellation within the prescribed deadlines, the modifications shall be deemed automatically accepted.
08
Contract termination
8.1 Termination by the Traveller
The Traveller may withdraw from the contract at any time before the start of the trip, subject to the penalties set out in article 9.
The notice of termination must be sent exclusively in writing by email to support@wayure.com, requesting confirmation of receipt from WAYURE. The date of receipt shall be the reference date for calculating the applicable penalties.
8.2 Termination by WAYURE
Failure to pay, even partially, the amounts due within the established deadlines constitutes grounds for automatic termination of the contract, without entitlement to a refund of amounts already paid.
WAYURE may also terminate the contract where, prior to the start of the trip, it finds itself unable to perform the contractual obligations due to unavoidable and extraordinary circumstances. In this case, WAYURE will refund in full the amounts paid, without further liability for compensation, within the deadlines provided for by applicable law.
09
Cancellation and penalties
9.1 Cancellation by the Traveller
The Traveller may cancel the trip at any time before the departure date. Cancellation must be communicated exclusively in writing to support@wayure.com and shall take effect from the date of receipt by WAYURE.
Cancellation penalties are determined based on the number of days between receipt of the notice and the departure date:
| Notice before departure | Applicable penalty |
|---|---|
| More than 30 days beforee.g. 32 days before | 30% of the total price of land services, plus full amount of any transport already purchased (including commissions and sales fees) |
| Within 30 days of departuree.g. 28 days before | 100% of the total cost of the trip, inclusive of all services included in the contract |
Services already purchased and non-refundable by their nature (air tickets, insurance, confirmed non-cancellable services) cannot under any circumstances be refunded and shall remain entirely at the Traveller's expense.
Penalties apply regardless of the reason for cancellation. Should the Traveller have taken out a cancellation insurance policy, any refund may be claimed exclusively from the insurance company, within the limits of the policy itself. WAYURE is in no case obliged to refund the penalties applied.
9.2 Cancellation due to reasons attributable to WAYURE
In the event that WAYURE, before the start of the trip, finds itself unable to perform the contract due to reasons attributable to its own organisation, the contract shall be deemed terminated and WAYURE will proceed with the full refund of all amounts paid by the Traveller, without further compensation save as otherwise provided by applicable law.
10
Trip execution and non-conformity
WAYURE is responsible for the correct execution of all services included in the combined trip, within the limits set out in article 161 of Royal Legislative Decree 1/2007.
The Traveller is required to notify WAYURE without delay of any discrepancy or non-conformity found during the execution of services, so that WAYURE may remedy it as quickly as possible. Notification must be made through the support contacts provided or, failing that, by email to support@wayure.com.
Failure to notify or delayed notification of any non-conformities may affect the assessment of WAYURE's liability and the Traveller's possible right to request price reductions or compensation.
WAYURE shall not be liable for disruptions arising from the Traveller's behaviour, acts of third parties unrelated to the contract, or unavoidable and extraordinary circumstances.
11
Enforcement of rights and limitation period
The Traveller's right to act for breach of contract or improper execution of travel services is subject to the limitation periods provided for by applicable legislation on combined trips.
Pursuant to article 169 of Royal Legislative Decree 1/2007 of 16 November (consolidated text of the General Law for the Protection of Consumers and Users), the limitation period is two years from the moment the action could have been brought.
12
Insolvency guarantee
WAYURE has taken out, in accordance with applicable legislation on combined trips, an insolvency protection guarantee, designed to ensure the refund of payments made by Travellers and, where necessary, their return from the trip.

14
Complaints, disputes and jurisdiction
The Traveller may submit complaints relating to the contracted trip or the execution of the contract by contacting WAYURE at the indicated addresses. Complaints must be submitted in writing to support@wayure.com, clearly stating the facts in question and attaching any relevant documents.
WAYURE undertakes to respond to the Traveller within a reasonable time, depending on the complexity of the matter.
The parties expressly agree that, for any dispute arising from the interpretation, execution or termination of this contract, the Court of Santiago de Compostela shall have exclusive jurisdiction.
WAYURE does not adhere to any alternative dispute resolution system (conciliation, mediation, arbitration). Upon the Traveller's express request, possible participation may be assessed on a case-by-case basis, without this creating any obligation on WAYURE.
15
Insurance and coverage
WAYURE has taken out, for the trip covered by this contract, a mandatory travel insurance policy with the company INTERMUNDIAL, including medical coverage and insurance for sports activities.
The policy number and complete documentation relating to the general, particular and special terms of the insurance will be communicated to the Traveller after the contract is signed and the insurance coverage is actually activated.
The Traveller declares to have been informed:
- Of the existence and characteristics of the included insurance coverage;
- Of the guarantees provided, the maximum amounts and any applicable excesses;
- Of the exclusions, limitations and conditions of operation set out in the policy.
The included insurance, once activated, is non-refundable under any circumstances, including in the event of trip cancellation or non-use for any reason. Any claims for reimbursement or indemnity must be submitted directly by the Traveller to the insurance company, in accordance with the procedures set out in the signed policy.
16
Variations and additional services after signing
Any request for modification, variation or addition to the services included in the contract, made by the Traveller after its signing, shall not be automatically included in the agreed price.
Such requests may result in:
- Additional costs arising from the requested services or changes made;
- Penalties, supplements or surcharges applied by suppliers, based on their contractual conditions;
- A management fee for the organisational, administrative and coordination activities carried out by WAYURE.
Modifications governed by this article include, by way of example: addition or modification of luggage transport, inclusion of additional luggage on already confirmed services, changes to accommodation, transfers or activities already booked, modifications during the trip to already started services.
WAYURE has no power to modify, reduce or cancel penalties applied by third parties. The requested modification will only take effect upon written confirmation by the Traveller and payment of the required amounts.
17
Independently purchased services and extraordinary assistance
WAYURE is responsible exclusively for the travel services expressly included in this contract and is in no case liable for disruptions, delays, cancellations or problems relating to services independently purchased by the Traveller, even where these are connected to the trip covered by the contract.
Independently purchased services include:
- Air, rail or other transport tickets;
- Transfer services, accommodation or activities not included in the contract;
- Insurance, optional services or benefits purchased directly by the Traveller from third parties.
Any requests for support or assistance in relation to services not included in the contract constitute extraordinary activity, non-mandatory and not included in the trip price. Should WAYURE, at its own discretion, agree to provide such assistance, it shall be subject to a fee determined on a case-by-case basis, plus any additional costs.
18
Communications and documentation
The parties agree that electronic mail constitutes a valid and effective means of communication for the purposes of this contract, provided it is sent to the addresses indicated in the contract and actually received by the recipient.
Every relevant communication (modifications, cancellations, complaints, requests for assistance, acceptance or rejection of variations) must be made in writing by email and shall be deemed validly made on the date of receipt by the recipient.
The Traveller undertakes to provide a valid and active email address, to monitor it regularly and to verify receipt of WAYURE's communications. Communications not received due to incorrect addresses or non-functioning inboxes cannot be attributed to WAYURE.
The Traveller declares to have received, reviewed and accepted the following documentation, which forms an integral part of the contract:
- The travel programme and applicable general terms;
- The insolvency guarantee certificate;
- Information relating to travel insurance.
19
Contract signature
In witness whereof, the parties declare to have carefully read, understood and fully accepted all clauses of this contract and sign it at the place and on the date indicated in the heading.
Signing takes place by electronic signature through the Yousign platform, which allows identification of the signing parties, guarantees the integrity of the document and ensures traceability of the entire signing process, in compliance with applicable law.
The Traveller acknowledges and accepts that the electronic signature affixed via Yousign has full legal validity and is equivalent, in all respects, to a handwritten signature. The contract, once electronically signed, will be transmitted to the parties in digital format and retained by WAYURE as proof of the contractual relationship.
